These Terms of Service ("Terms") form a binding agreement between you and California Hair Braiders ("CHB", "we", "us") governing your use of the CHB mobile app, web app, and related services (the "Service"). By creating an account or using the Service you agree to these Terms.
1. Eligibility
You must be at least 13 years old (16 in the EU) to use CHB. Braider accounts must represent a real person offering braiding services.
2. Nature of the Service
CHB is a discovery and lead platform. We help clients find independent braiders and send appointment requests. Braiders are independent professionals, not employees or agents of CHB. Any service performed is a direct agreement between the client and the braider.
3. Accounts
- You are responsible for your login credentials and all activity on your account.
- Provide accurate information and keep it current.
- We may suspend or terminate accounts that violate these Terms.
4. User content
You retain ownership of the content you post (profile, portfolio, messages). You grant CHB a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content solely to operate the Service.
You will not post content that is:
- Unlawful, hateful, harassing, sexually explicit, or violent.
- Infringing on someone else's IP or privacy.
- Misleading, spam, or a scam.
We use a zero-tolerance policy for objectionable content and abusive users, as required by Apple's App Store Guideline 1.2. Report violations to support@californiahairbraiders.app or with the in-app report tool. We will review within 24 hours and remove content and/or ban the user as appropriate.
5. Payments
Client accounts are free. Braider Pro subscriptions are billed on the web through our payment processor. Payment for braiding services is arranged directly between the client and the braider. CHB is not a party to those transactions.
6. Cancellations & no-shows
Each braider sets their own cancellation policy on their profile. Please review it before booking. Repeated no-shows may lead to account suspension.
7. Prohibited use
- Reverse engineering, scraping, or automated access to the Service.
- Using the Service to solicit for anything other than braiding-related services.
- Impersonating another person or braider.
8. Disclaimer
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. CHB DOES NOT WARRANT THE QUALITY, SAFETY, OR OUTCOME OF ANY BRAIDING SERVICE ARRANGED THROUGH THE APP.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHB'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID CHB IN THE 12 MONTHS BEFORE THE CLAIM, OR USD $100, WHICHEVER IS GREATER.
10. Termination
You may delete your account at any time in Profile → Settings → Delete account. We may suspend or terminate access for violations of these Terms.
11. Governing law
These Terms are governed by the laws of the State of California, USA.
12. Apple App Store — EULA addendum
The following applies when you download CHB from the Apple App Store:
- These Terms are between you and CHB only, not with Apple. Apple is not responsible for the app or its content.
- The license granted is a non-transferable license to use the app on any Apple-branded device you own or control, as permitted by the App Store Terms.
- CHB, not Apple, is solely responsible for maintenance, support, warranties, product claims, and IP claims relating to the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
13. Changes
We may update these Terms. Continued use of the Service after changes take effect means you accept the updated Terms.
